Your work is yours
Fonterie claims no ownership of your source material — the handwriting, sheets, photos and drawings you give it — or of the outlines you draw or correct, or the font file you export. That work is yours. Nothing in this licence transfers it to us, and nothing in it gives us permission to use it.
What this licence controls is narrower, and worth saying plainly: the terms on which you may use a font that Fonterie’s software produced for you. Fonterie costs nothing and asks for nothing up front. This is what it asks for instead — that what comes out is for personal use, unless you licence it for more.
What the words mean
- The Font — a font file exported from Fonterie, and any font made from one.
- We, us, Fonterie — Maor Shushan, an individual, who publishes Fonterie and grants this licence.
- You — the person who exported the Font, and anyone who later receives a copy of it.
- Personal use — use by you, for yourself, your family or your friends, where nobody is paying and nothing is being sold: private letters and documents, a diary, gifts and invitations, schoolwork, a personal site or social account that is not promoting a business, and unpaid personal projects.
- Commercial use — any use by or for a business, an employer, a client, or any other organisation, and any use connected with money coming in. It includes logos, wordmarks and trademarks; products, packaging and merchandise; advertising; paid publications; an organisation’s website, app, documents or presentations; and any distribution of the Font for a fee or inside anything sold.
If a use does not obviously sit on one side of that line, treat it as commercial and ask. We would rather answer the question than have you guess at it.
What you may do, free of charge
Subject to the rest of this licence, we grant you a worldwide, royalty-free, non-exclusive licence to:
- install the Font on any number of devices you own or control, and use it there;
- use the Font in your own personal, non-commercial work, including work you publish for free;
- embed the Font in a personal document, image or PDF you share, in a form the Font cannot practically be extracted from and reused;
- give copies of the Font file to other people, free of charge, under clause 5.
The licence runs for as long as you keep to it. It is not limited in time and we do not charge for it.
What is not included
Everything that falls under Commercial use in clause 2. To spell out the cases that come up most:
- anything you are paid for, including freelance and client work;
- anything for the business you work for, run or own;
- setting a logo, brand name or trademark in the Font;
- a commercial website or a shipped application, whether the Font arrives by
@font-face, as a webfont, or inside an app bundle; - selling, renting or sublicensing the Font, or including it in anything sold — a template, theme, plugin, asset pack, print-on-demand product or font collection;
- advertising, packaging and merchandise.
If your use is on this list, you need a commercial licence. Clause 8 says how.
Passing the Font on
You may give the Font file to other people, provided that:
- you give it away free — no charge, no payment in kind, and not as part of anything sold or paid for;
- you pass on the file exactly as Fonterie exported it, unmodified, with the licence text and copyright line in its metadata intact;
- whoever receives it can tell what terms it comes under. The file states them itself, which is normally enough;
- you do not present it as your own product, or as available on any other terms.
Anyone who receives a copy gets this same licence, from us, on these same terms. Nobody receives more through you than you hold yourself.
What you may not do
- Remove, obscure or alter the licence notice, copyright line or licence URL embedded in the Font, including by converting the file to a format that drops them.
- Distribute a modified Font, a subset of one, or one converted to another format. Changing the Font for your own use is fine — that is what the editor is for — but the copy you pass on has to be the one Fonterie exported.
- Claim the Font is available under any other licence, or offer it as open source.
- Use the Font, or Fonterie itself, to reproduce a typeface you have no right to reproduce. Tracing or photographing someone else’s letterforms does not make them yours, and this licence does not make it lawful.
If the licence ends
This licence ends automatically if you break it and have not put it right within 30 days of us telling you what the problem is. If it ends, stop using the Font and delete the copies you hold. Work you had already published in good faith before that point may stay where it is.
Your source material and your outlines are unaffected — they were never ours, and this does not reach them. What ends is your permission to use the font file Fonterie compiled from them.
Getting a commercial licence
Commercial licences are available, and asking for one is the intended route for any use outside clause 3. Write to contact@fonterie.com with the name of the font and what you want to use it for.
There is no published price list yet; terms are agreed in writing, case by case. A commercial licence, once granted, replaces this one for the font it names.
No warranty
The Font is provided “as is”. A font is compiled software and can behave in ways nobody intended: a glyph may render wrongly in one application, a layout feature may be ignored by an older renderer, a character you need may turn out to be missing.
To the fullest extent the law allows, we give no warranties about the Font of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profit, lost data or business interruption arising out of the Font or this licence, and our total liability in connection with the Font will not exceed what you paid for it — which, under this licence, is nothing.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Changes to this licence
We may publish a new version of this licence, which will apply to fonts exported after it takes effect. A font already exported keeps the version it was exported under, and that version is written into the file itself — so which terms govern a given font is a question the font can answer, not one you have to remember.
We will not use a new version to restrict, after the fact, something you were already entitled to do.
Governing law
This licence is governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Yafo have exclusive jurisdiction over any dispute arising out of it. If you are a consumer resident elsewhere, this does not deprive you of the protection of any mandatory rules of your own country’s law.
Using Fonterie is also subject to the terms of service. Where the two disagree about a font you have exported, this licence governs. This English text is the governing one; a Hebrew translation is published beside it, and where the two differ, this text prevails.
